DE 172503020 Validity of conditions These terms and conditions of sales are deemed to be the operative terms in any contractual transaction between GermanArtBooks.com and any potential buyer who completes the order form of GermanArtBooks.com for goods offered for sale by GermanArtBooks.com on this website. Conclusion of contract Every buyer can order via internet, e-mail, phone, fax of mail. With your order you agree to these General Terms and Conditions of Business, especially to return all goods, if a contractual transaction according to these terms fails. Prices The price of the goods shall be the price quoted on the website on the date of acceptance of the order by GermanArtBooks.com, subject to any inadvertent pricing errors (whether technical or otherwise) by GermanArtBooks.com. If GermanArtBooks.com discovers a pricing error for any goods that the buyer orders, then GermanArtBooks.com will cancel the order without penalty and notify the buyer of the error. The price of the goods is inclusive of any applicable value added tax, which the buyer shall be liable to pay to GermanArtBooks.com as part of the order value. From EUR 19.80 on, all goods are sent within Germany without further packing and shipping cost. The price of the goods does not include the cost of delivery for any goods delivered outside Germany. For such orders, the buyer will pay the delivery charges of GermanArtBooks.com by the method and to the premises specified in the buyer's order for transport, packaging and insurance as quoted on the website on the date of acceptance of the order. Payment of goods delivered abroad by credit card or advance invoice. Delivery/Invoicing Orders and invoices are sent to the address given in buyer's order. Shipping time Unless prevented by circumstances beyond his control, all goods leave the warehouse of GermanArtBooks.com within two to four working days. If goods are out of print, buyer will be informed immediately in writing (e-mail). Payment terms The following payment terms are accepted by GermanArt Books.com: - invoice (payable within two weeks without discount) and/or advance invoice - money transfer - credit card (via iPayment) - PayPal Reservation of proprietary rights All goods delivered shall remain property of GermanArtBooks.com until buyer having paid all outstanding invoices. Withdrawal, warranty and liability The buyer has the right to withdraw from the contractual transaction within two weeks after the goods have been delivered by returning the goods in an undamaged condition and giving written notice of withdrawal to GermanArtBooks.com, who shall credit the buyer's credit card for the price of the goods. The right to a two-weeks' "Cooling Off" period will not apply where the contract is for the supply of audio-recordings goods if the seal on the audio recording goods has been broken. The buyer shall be responsible for paying the cost of returning the goods to GermanArtBooks.com by the same method as they were originally delivered in the event that the goods had been dispatched by GermanArtBooks.com prior to receipt of the written notice of withdrawal from the buyer. If the contract is cancelled by the buyer, he is obliged to restore the goods to GermanArtBooks.com in a resaleable condition and take reasonable care of such goods in the meantime. If the buyer does not return the goods then the buyer will have to pay the cost that incurs GermanArtBooks.com in recovering them. Copyrights All intellectual property and other proprietary rights shall be, and shall remain, the property of the respective publisher. All technical, business or similar information created by GermanArtBooks.com before, during and after the course of the contractual transaction shall be, and shall remain, the property of the GermanArtBooks.com only.
